Tired of Being a Salt Lake City Landlord? Selling a Rental With Tenants, the $342 License Fee, and Utah's 15-Day Rule

Selling a Salt Lake City rental you're done managing? How the city's rental business license and Good Landlord discount work, Utah's 15-day and 3-business-day notice rules, the 30-day deposit deadline, keeping the 45% residential exemption with a tenant in place, Utah's 4.45% rate and federal recapture, and when a cash sale beats listing. Call (405) 622-8705.

Short answer: You can sell a Salt Lake City rental with the tenant in place or empty it first, and in Utah the empty-it-first path is quicker than in most states: a month-to-month tenant gets a 15-day notice. Before choosing, run three numbers. What the license and repairs cost you each year, what you’d net listing a vacant, refreshed house in a market where nearly half of homes are taking price cuts, and what you’d net selling it occupied to an investor. For many tired landlords, the tenant-occupied sale is simpler and closer in price than they expect.

This guide is for one kind of Salt Lake City owner in particular: someone who bought a brick bungalow or small duplex on the west side, in Rose Park, Glendale or Poplar Grove, or a starter home near Sugar House, rented it out when they moved, and now spends their weekends on repair calls, license renewals and turnover. Maybe you live in Lehi now, or in another state entirely.

What is the rental license actually costing you?

More than you might think if you’ve let your Good Landlord status lapse. Salt Lake City requires a business license for every residential rental, single-family homes and duplexes included (Salt Lake City Landlord/Tenant program). The FY2027 consolidated fee schedule, amended June 16, 2026, lists the per-unit fee two ways (Salt Lake City fee schedule):

  • $35 per rental unit with Good Landlord certification.
  • $342 per rental unit without it.

For a duplex, that’s $70 a year versus $684. To get the discount, the city’s program requires a city-approved landlord training course of at least four hours, refresher training every three years, records of occupancy denials and evictions, and compliance with fire, zoning and property maintenance codes. None of that is hard. It’s just one more thing a landlord who’s already checked out tends to let slide.

There’s a separate category for owner-occupied rentals (four units or fewer where the owner lives in one), but if you’ve moved away, you’re paying the standard per-unit rate.

Should you sell with the tenant in place or empty it first?

It depends on who you’re selling to.

Selling occupied makes sense when the tenant pays on time and the buyer is an investor. The lease travels with the house, the buyer gets rent from day one, and you skip a vacancy month. The tradeoff is showings: tenants don’t have to love strangers walking through, so your lease’s access clause matters, and so does a little goodwill (a rent credit for cooperating often pays for itself).

Selling vacant makes sense when you want owner-occupant buyers who’ll pay retail. Utah gives you a short path. Under Utah Code 78B-6-802, a month-to-month tenant who stays past the end of a rental period after receiving notice 15 calendar days or more before that period ends is in unlawful detainer. A fixed-term lease, on the other hand, generally runs to its end date unless the lease itself says otherwise.

If the problem is unpaid rent, the same statute’s pay-or-vacate notice gives the tenant three business days after service, and the Utah Courts point out that business days skip weekends and court holidays (Utah Courts: eviction information for landlords). The notice must be served personally, by registered or certified mail, or by the other methods in 78B-6-805. If you’re not sure your notice was right, a Utah landlord attorney is cheaper than filing twice.

Can you raise the rent first to make the numbers work?

You can, within your lease. Utah Code 57-20-1 bars cities and counties from enacting rent control on private residential property without the Legislature’s approval, so Salt Lake City has no local cap. For a sale, though, a sudden increase can backfire: an investor values the house partly on whether the rent is stable, and a tenant who leaves mid-listing turns an occupied sale into a vacant one you didn’t prepare for.

Who handles the security deposit at closing?

Put it in the contract. Utah’s deadline is tight. Under Utah Code 57-17-3, within 30 days after a tenant vacates and returns possession, the owner must send the deposit balance, any prepaid rent, and an itemized written explanation for each deduction. If that doesn’t happen, the tenant can serve a notice giving five business days, and an owner who still doesn’t comply can owe the full deposit, all prepaid rent and a $100 penalty, plus court costs and attorney fees if the court finds bad faith.

In an occupied sale, the usual approach is to credit the deposit to the buyer at closing and give the tenant written notice of who holds it now. In a vacant sale, settle it with the tenant yourself before you list, and keep the move-out photos.

Does the 45% residential exemption survive the sale?

Usually, if someone keeps living there. Utah’s primary residential exemption cuts the taxable value of qualifying homes to 55% of market value, and it covers a house that is a tenant’s primary residence for at least 183 consecutive days, not just an owner-occupied one (Utah State Tax Commission). Salt Lake County notes a tenant can even be a family member who doesn’t pay rent (Salt Lake County Assessor).

Two practical points for sellers:

  • A long vacancy can be a problem. A house that sits empty for months while you renovate and list may not meet the occupancy test for that year. Ask the assessor before you assume.
  • The buyer files after 2026. The Tax Commission says that under 2026 SB 238, starting January 1, 2027, a change of ownership requires the owner to file Form TC-473A with the county Board of Equalization by September 15 to receive or keep the exemption. That’s mostly the buyer’s job, but an investor will price it in, so having a current lease on hand helps.

What will the IRS and Utah take from the sale?

Two layers, and depreciation is the one landlords forget. On the federal side, profit on a rental you’ve held more than a year is a long-term capital gain, but the portion that comes from depreciation you took, the unrecaptured Section 1250 gain, is taxed at a maximum 25% rate (IRS Topic 409).

Utah taxes the gain as ordinary income at a single flat rate. The Legislature cut that rate to 4.45% for tax year 2026 with SB 60, down from 4.5% for 2025. Ask a CPA before you sign: a 1031 exchange into something easier to own, or an installment sale, can change the after-tax answer more than a few thousand dollars of price.

What is the Salt Lake City market telling landlords this fall?

That prices are strong but patience is required. Over the three months ending September 2026, Redfin reported a median Salt Lake City sale price of $635,297, up 10.9% year over year, a median of 43 days on market (up from 40), a 98.0% sale-to-list ratio, and price drops on 48.8% of homes. Sales fell to 451 in September from 489 a year earlier (Redfin Salt Lake City housing market).

Rates aren’t helping owner-occupant buyers either: Freddie Mac put the average 30-year fixed rate at 7.32% on October 22, 2026 (Freddie Mac PMMS). For a tired landlord, that combination means a vacant, refreshed rental can still sell well, but it may take longer than the median, and you’ll carry utilities, insurance and Salt Lake’s winter inversion season while it sits.

From our deals

Most landlords who call us aren’t in crisis. They’re worn down. The rent covers the mortgage, but the furnace in the brick bungalow is original, the tenant has been there six years at a below-market rent, and the owner doesn’t want to be the one to raise it or end the lease. In those cases the cleanest sales were the ones where the owner told the tenant early, honestly, what was happening, and where we agreed in writing to keep the lease in place. The tenant stayed, the deposit moved to us at closing, and the owner never had to manage a turnover.

When is a cash sale the wrong move for a Salt Lake City rental?

When the hassle is fixable. Don’t sell for cash before looking at alternatives if:

  • The house is in good shape and you can get it vacant easily. A month-to-month tenant, a 15-day notice and a fresh coat of paint can open you up to owner-occupant buyers at retail.
  • The real problem is management. If you like the asset but not the phone calls, a property manager may solve it for a percentage of rent.
  • Your tax bill drives the decision. If recapture and gain are large, a 1031 exchange may beat any price difference. Talk to a CPA first.
  • The tenant wants to buy it. A sale to a long-term tenant can be the simplest close of all.

A cash sale fits better when the house needs major work, the tenant is behind or won’t allow showings, you live out of state, or you want a firm closing date before the next license renewal or furnace season.

How would a HomeCashOffer rental sale work in Salt Lake City?

We buy Salt Lake County rentals occupied or vacant, including houses with long-term tenants, below-market rents or deferred maintenance.

  1. Tell us the address, the lease terms, the rent, and whether the tenant is current.
  2. We review the house with respect for the tenant’s notice rights, by photos and a scheduled walkthrough.
  3. We send a written offer. You can ask for one without committing to anything.
  4. A Utah title company handles the payoff, prorates the rent, and credits the security deposit.
  5. You choose the closing date, and the tenant can stay under their lease.

Frequently asked questions

Can I sell my Salt Lake City rental with the tenant still living there?

Yes. A sale doesn't cancel a lease, so the buyer generally takes the house subject to it. Investors often prefer a paying tenant. If you want the house empty instead, a month-to-month tenancy in Utah can be ended with a notice served at least 15 calendar days before the end of the rental period under Utah Code 78B-6-802(1)(b); a fixed-term lease normally runs to its end date.

What does Salt Lake City charge for a rental business license?

Salt Lake City requires a business license for residential rentals, including single-family homes and duplexes. The FY2027 consolidated fee schedule lists $35 per rental unit with Good Landlord certification and $342 per unit without it. Certification requires a city-approved landlord training course of at least four hours, plus refresher training every three years.

Can I raise the rent to cover costs before I sell? Is there rent control in Salt Lake City?

Utah Code 57-20-1 prohibits counties, cities and towns from enacting rent control on private residential property without the Legislature's express approval, so Salt Lake City has no local rent cap. You still have to follow your lease and give proper notice of any increase.

Who returns the security deposit when I sell a rented house in Utah?

Agree on it in writing at closing. Utah Code 57-17-3 requires the deposit balance, any prepaid rent, and an itemized list of deductions within 30 days after the tenant vacates and returns possession. If the owner misses that, the tenant can serve a notice giving five business days, after which the owner may owe the full deposit plus a $100 penalty. Most sales transfer the deposit to the buyer, who then takes on that duty.

Will my rental lose the 45% Utah residential exemption when I sell?

Not because of the sale itself if a tenant keeps living there. Utah's primary residential exemption covers a dwelling that is a tenant's primary residence for at least 183 consecutive days, and the owner files a residential declaration. Starting January 1, 2027, under 2026 SB 238, a change of ownership requires the new owner to file Form TC-473A by September 15 to keep it, so it's mainly the buyer's paperwork.

What taxes do I owe when I sell a Salt Lake City rental?

Federal capital gains tax on the profit, plus up to a 25% maximum rate on unrecaptured Section 1250 gain, which is roughly the depreciation you took (IRS Topic 409). Utah taxes the gain as ordinary income at a flat 4.45% for 2026 under SB 60. A CPA can tell you whether a 1031 exchange or an installment sale makes sense.

Is the Salt Lake City market good for selling a rental right now?

Prices are up but buyers are slower. Redfin reported a median sale price of $635,297 over the three months ending September 2026, up 10.9% year over year, with 43 median days on market and price drops on 48.8% of homes. A rental with a tenant and dated finishes usually takes longer than that median to sell to an owner-occupant.
